General terms and conditions

This translation is provided for information only. The German version is legally binding.

Last updated: 17 October 2026

These general terms and conditions (terms) govern the use of the digital stamp card “Stammkunde” by businesses. The provider is Alexander Siarsky, Maiengasse 55, 4056 Basel, Switzerland (“we”). The customer is the business that orders Stammkunde (“business”).

1. Scope

Stammkunde is aimed exclusively at companies (hospitality, retail, services, etc.), not at consumers. Deviating terms of the business only apply if we have confirmed them in writing.

2. Services

  • Digital stamp card in the business’s look for Apple Wallet, Google Wallet and the browser
  • Web app for stamping and redeeming on your own phones or tablets, logins for staff
  • Counter QR code and table tent to print, statistics, messages to customers
  • Support via the app and help with setup, if needed online or by phone (no on-site visits)

The scope of each plan (Basic, Pro) is based on the price overview at the time of the order or plan change. We continuously develop Stammkunde and may adapt features as long as the agreed core of the service is maintained.

Apple Wallet and Google Wallet are services of Apple and Google. We have no influence on their availability, rules or changes.

3. Conclusion of the contract

The business orders via the form on our website, by email or in person. The contract is concluded as soon as we confirm the order or activate access. The subscription starts on the day of activation unless agreed otherwise.

4. Prices and payment

  • The prices in the price overview apply, currently Basic CHF 19.90 per month or CHF 199.00 per year and Pro CHF 29.90 per month or CHF 299.00 per year. There is no setup fee.
  • All prices in Swiss francs. We are not registered for VAT; no VAT is charged.
  • The fee is invoiced in advance for each billing period (month or year), on the first day of the period, and is payable within 30 days (monthly and yearly billing).
  • In the event of late payment, we send a reminder. If payment is still not made 14 days after the reminder, we may block access; customers’ cards then no longer show new stamps. The fee remains due.
  • We announce price changes at least 2 months in advance. The business may then terminate the contract as of the date of the price change.

5. Plan changes

  • Upgrade from Basic to Pro: at any time in the app under “Subscription”. Pro applies immediately, the new price from the next invoice. For yearly billing, we charge the price difference for the remaining term pro rata (per started month); the invoice is payable within 30 days.
  • Change from Pro to Basic: at any time in the app under “Subscription” or via support, effective at the end of the current billing period. Until then all Pro features and the design remain; afterwards the Basic price applies and colours, stamp symbol and custom stamp images are reset to the standard design. Name, logo, reward and number of stamps remain.
  • Billing type, start date and notice period remain unchanged when changing plans.

6. Term and termination

  • Monthly billing: term of one month from the start (e.g. 7 Oct – 6 Nov), renewing automatically for another month. Can be cancelled up to 10 days before the end of the term at the latest.
  • Yearly billing: term of one year from the start. Can be cancelled up to 30 days before the end of the term at the latest; otherwise the subscription renews for another year.
  • The business cancels in the app under “Subscription” or in writing (email is sufficient). A cancellation can be withdrawn until the last day.
  • Both parties may terminate without notice for good cause, e.g. in the event of serious abuse or persistent late payment. Fees already paid are not refunded in this case, unless the good cause is attributable to us.

7. End of contract and data

All features are available up to and including the last day of the subscription. After that, stamping, new cards and staff logins are blocked; customers’ cards are no longer valid and show “Stamp card ended”. The owner can export the data (cards and stamp history) in the app for 90 days after the last day. We then permanently delete the business’s data. We keep invoices as long as required by law.

8. Obligations of the business

  • Keep login details secret and use a separate login for each person. The business is responsible for actions taken via its logins.
  • Only use content to which it holds the rights (e.g. logo) and not send unlawful, misleading or harassing messages to customers.
  • Rewards to customers are granted solely by the business. We are not a party to this loyalty programme.
  • Refer customers to the privacy policy if they ask about it (it is linked on every card page).

9. Data protection

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP); the database is in Zurich. Stammkunde is deliberately lean: no contact details are collected from customers, only the card (with an optional, freely chosen name) and the stamps. Details are in the privacy policy.

The business is responsible for its customers’ cards; we process this data on its behalf (processing on behalf under Art. 9 FADP). The following applies:

  • We process card data only to operate the stamp card and not for our own purposes (no advertising, no profiles across several businesses).
  • We protect the data with appropriate technical and organisational measures (including encrypted transmission, role-based access, separation of businesses, log of support access).
  • We use the service providers named in the privacy policy (Supabase, Vercel, Apple, Google). We announce new service providers in advance.
  • We don’t pass card data on to third parties; only the named technical service providers are involved, on our behalf.
  • When scanning, the business sees the individual card (name or nickname, stamp count, last visit) and in the statistics only aggregated figures, no list of individual customers.
  • Deletion requests from customers: the customer instructs the business and identifies themselves with the card or card number. We provide the “Delete card” tool for this; checking and carrying out the deletion is the business’s responsibility. On request we help via support.
  • We notify the business of data security breaches without delay.
  • After the end of the contract, we delete the card data once the export period of 90 days has expired.

10. Availability and support

  • We operate Stammkunde with customary care but cannot guarantee uninterrupted availability.
  • Where possible, we carry out maintenance outside usual opening hours.
  • Support via the app (menu “Support”) and by email at support@stammkunde.ch, Mon–Fri 9 am–5 pm (excluding public holidays). We usually reply within 24 hours. For outages that prevent stamping, you can also reach us by phone during these hours at +41 77 999 58 11.

11. Liability

We are liable for damage caused intentionally or through gross negligence. Any further liability, in particular for slight negligence, indirect damage, lost profit, loss of data and for outages of Apple, Google or other third parties, is excluded to the extent permitted by law. In any case, liability is limited to the fees of the last twelve months.

12. Changes to the terms

We announce changes at least 30 days before they take effect in the app or by email. If the business does not agree, it may terminate the contract as of the effective date. Otherwise the changes are deemed accepted.

13. Final provisions

Swiss law applies. The place of jurisdiction is Basel-Stadt. Should any provision be invalid, the remainder of the terms remains valid.
